Terms of Service

Cusgro Foods Private Limited (referred to as "CusGro," "Company," "we," or "us") owns and operates the website and mobile applications (collectively, the "Platform"). These Terms of Service (the "Agreement") govern your access to and use of the Platform and the purchase of any customizable dishes or other products ("Products") and services offered by CusGro.

ACCEPTANCE OF TERMS

By accessing, browsing, or otherwise using the Platform, you acknowledge that you have read, understood, and unequivocally agree to be bound by these Terms of Service, the Privacy Policy, and all other operational guidelines posted on the Platform. If you do not agree to this Agreement, you must immediately cease all use of the Platform.

ELIGIBILITY

You represent and warrant that you are at least eighteen (18) years of age and competent to enter into a contract under Indian law. If you are under 18, you may use the Platform only with the involvement of a parent or legal guardian.

1. USER ACCOUNT AND RESPONSIBILITIES

A. Account Creation

To place an order or use certain features, you must register for an account using a valid email address and phone number. You are responsible for maintaining the confidentiality of your account credentials (password). We are not liable for any loss or damage resulting from your failure to maintain account security.

B. Accurate Information

You agree to provide accurate, complete, and current information during registration and all transactions. Providing false or inaccurate information may lead to the immediate termination of your account.

C. Prohibited Use

You shall not host, display, upload, modify, publish, transmit, or share any information on the Platform that:

  • Belongs to another person and to which you have no right.
  • Is grossly harmful, defamatory, obscene, pornographic, invasive of another's privacy, or otherwise unlawful.
  • Infringes any patent, trademark, copyright, or other proprietary rights.
  • Violates any law for the time being in force in India.
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of the Platform.

2. PRODUCTS, ORDERING, AND CUSTOMIZATION

A. Product and Pricing

All Products and prices are subject to change without prior notice at our sole discretion. We strive to accurately display descriptions, but we do not guarantee exactness in color, appearance, or final weight due to the inherent nature of food and our customization process.

B. Customizable Dishes

Our service is centered on providing customizable dishes. By placing an order, you acknowledge that the final Product is prepared based on the specific quantity and ingredient selections made by you at the time of order placement.

C. Quantity Variance

Due to the nature of fresh ingredients, minor variance between the quantity ordered and the quantity supplied may occur. You will only be charged for the actual quantity supplied. Any excess amount paid will be refunded as set forth in the Refund Policy below.

3. ORDER CANCELLATION POLICY

CANCELLATION BY YOU

Orders can be cancelled before the cutoff time for your selected delivery slot. Once the cutoff time has passed, orders cannot be cancelled as ingredient preparation is already underway.

For cancelled orders, you can choose your refund method:

  • Instant CusCredits: Refund credited immediately to your CusCredits wallet
  • Original Payment Method: Refund processed to your bank/UPI (5-7 business days)

You will receive a refund for your cancelled orders that have been accepted in accordance with the Refund Policy. Refunds are typically processed within 2-4 hours of cancellation approval.

Note: Cutoff times vary by delivery slot (typically 10 AM for morning slots and 12 PM for evening slots). Cancellation is only available for orders placed today, not for past or future dated orders.

CANCELLATION BY CusGro

CusGro reserves the right to cancel any order at its sole discretion in the event of product unavailability, technical errors, invalid address details, reasons identified by our fraud avoidance team, or non-compliance with these Terms. Upon such cancellation, a full refund will be processed in accordance with the Refund Policy.

4. REFUND AND REDRESSAL POLICY

A. Refund for Customization Errors

If a dish is delivered with a verified, confirmed error in customization (e.g., an incorrect ingredient was used, particularly one that violates a specific exclusion or allergy note), the following remedy will apply:

  • You shall be eligible for a full refund equivalent to the value of the specific incorrect ingredient or a new, correctly customized ingredients in a dish, at the Company's sole discretion.
  • You must report the error with clear evidence (e.g., photographs) to the Customer Care Team within two (2) hours of delivery.

B. Quality and Delivery Issues (Late/Spoilage)

Delayed Delivery: Delivery timeframes are estimates and not guarantees. The Company is not liable for minor delays. In cases of significant and verified delay (as determined by CusGro) not caused by Force Majeure events, the Company may, at its sole discretion, issue a discount code or service credit for a future order as a gesture of goodwill.

Product Spoilage: If a dish is verified to be unfit for consumption (e.g., confirmed spoilage or severe quality defect) upon delivery, the remedy will be limited to a full refund for the portion of the dish confirmed to be unfit or a replacement of the affected portion, at CusGro's sole discretion.

C. Refund Processing Timetable

For refunds processed back to the original source of payment (bank account, credit/debit card, or UPI), the amount will typically be credited within five (5) to seven (7) business days from the date the refund is officially approved by CusGro.

D. Refund Processing Time

For eligible refunds, we process refunds within 2-4 hours of approval. However, the actual credit to your account may take 5-7 business days depending on your bank's processing time. Refunds to CusCredits are processed instantly.

5. DELIVERY AND RISK

Delivery of Products will be made by CusGro's internal team or assigned logistics partners. Title and risk of loss for all Products ordered shall pass to you upon delivery of the Products at the shipping address provided by you. You are responsible for checking the package condition before accepting delivery.

6. SHIPPING AND DELIVERY POLICY

A. Delivery Areas and Serviceability

We currently deliver to select pin codes within Gurugram. Your shipping address and pin code will be verified before you proceed to payment. If your area is not serviceable by our delivery partners, you may be requested to provide an alternate shipping address within our serviceable areas.

B. Delivery Time Slots

You can select from available delivery time slots during checkout. Each slot has a specific cutoff time for order modifications and cancellations (typically 10 AM for morning delivery slots). Orders placed after the cutoff time for a particular slot will be delivered on the next available slot.

C. Delivery Attempts

Our delivery team will make a maximum of two (2) attempts to deliver your order within the selected time slot. If you are not reachable or unavailable to accept delivery after two attempts, CusGro reserves the right to cancel the order. In such cases, a refund will be processed in accordance with our Refund Policy, minus any actual costs incurred for the attempted delivery.

D. Delivery of Perishable Goods

Given the perishable nature of our Products, we strongly recommend that you ensure someone is available to receive the delivery at the designated time. Our delivery executives are instructed to hand over Products only to the customer or an authorized representative at the delivery address.

E. Delivery Timeframes

Displayed delivery timeframes are estimates and not guaranteed. While we strive for punctuality, deliveries may occasionally be delayed due to:

  • Traffic conditions and weather
  • Logistics challenges
  • Unexpected high order volumes
  • Other circumstances beyond our reasonable control

CusGro will not compensate for any inconvenience caused by delays in delivery. We will, however, make reasonable efforts to inform you of significant delays via SMS or email.

F. Checking Your Order Upon Delivery

Before accepting delivery, please verify:

  • The package integrity is maintained
  • The number of items matches your order
  • The Products appear fresh and undamaged

G. Shipping Charges

Shipping charges, if applicable, will be displayed at checkout. These charges may vary based on your delivery location, order value, and delivery time slot. All delivery charges include applicable taxes.

7. INTELLECTUAL PROPERTY RIGHTS (IPR)

CusGro is the sole owner of the brand, logo, and the Platform. All content, including text, graphics, Product listings, and the software used in the Platform (React, Vite, Supabase, Drizzle) is the property of CusGro or its licensors and is protected by Indian copyright and trademark laws. You are prohibited from copying, reproducing, redistributing, or creating derivative works from any Content without prior written consent from CusGro.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

A. Disclaimer of Warranties

Your use of this Platform and the purchase of Products is at your sole risk. The Platform, Products, and services are offered on an "as is" and "as available" basis. To the maximum extent permitted by applicable laws, CusGro expressly disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

B. Limitation of Liability

The entire liability of CusGro for any claim arising out of this Agreement or the use of the Platform is strictly limited to the amount paid by you for the Product or service that gave rise to the claim. CusGro shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, goodwill, or data.

9. INDEMNIFICATION

You agree to release, indemnify, and hold harmless CusGro, its employees, officers, and agents from all claims, losses, damages, costs, and expenses (including reasonable attorney's fees) relating to or arising out of (1) your breach of any provision of this Agreement, (2) your use of the Platform or Products, or (3) your infringement of any intellectual property or other proprietary right of any person or entity.

10. ACCOUNT DELETION AND TERMINATION

A. Termination by CusGro

CusGro reserves the right to terminate your account and access to the Platform immediately, without prior notice, if you breach any of these Terms or engage in any fraudulent or illegal activity.

B. User Account Deletion

You may request to delete your account at any time by contacting the Grievance Officer. Your request will be processed, and your personal data will be completely erased from our active systems within fourteen (14) days of a verified request, as detailed in the Privacy Policy.

11. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana.

GENERAL PROVISIONS

Force Majeure

CusGro shall not be liable for any cessation, interruption, or delay in performance due to events beyond its reasonable control, including natural disasters, war, pandemic, power failure, or computer hacking.

Severability

If any part of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining parts shall remain in full force and effect.

Entire Agreement

This Agreement, along with the Privacy Policy (incorporated herein by reference), constitutes the entire agreement between you and CusGro.

This document is an electronic record in terms of the Information Technology Act, 2000 and does not require any physical or digital signatures.

PAYMENT TERMS

Accepted Payment Methods

We accept all major credit cards, debit cards, UPI, net banking, wallet payments, and Cash on Delivery (COD). All digital payments shall be processed through secure payment gateways.

Cash on Delivery (COD)

COD is available for all eligible products and delivery areas. There may be order value limits for COD transactions based on your delivery location and order history. CusGro reserves the right to modify COD availability at its discretion.

Payment Issues

In case of failed transactions, if the amount is deducted from your account, it will be automatically refunded within 5-7 business days. CusGro is not liable for any banking charges or penalties incurred during the transaction process.

Account Information Summary

To place an order or use certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials. Specific data collection and security practices are detailed in our Privacy Policy.

MODIFICATIONS TO TERMS

CusGro reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically for updates.

THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites or services. CusGro is not responsible for the content, privacy policies, or practices of any third-party sites. Your interactions with these sites are solely between you and the third party.

HEALTH AND ALLERGY DISCLAIMER

A. Ingredient Information

While we provide detailed ingredient information and customization options, we cannot guarantee that our kitchen is completely free from allergens. Cross-contamination may occur despite our best efforts.

B. Medical Conditions

Customers with severe allergies, dietary restrictions, or medical conditions should exercise caution and consult with healthcare professionals before consuming our Products. CusGro is not liable for any adverse reactions resulting from food allergies or sensitivities.

TERMINATION OF SERVICES

CusGro reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
